Em 23 de janeiro de
2013 o Conselho da Europa determinou que a Corte Europeia de Direitos Humanos
aprecie com celeridade o caso proposto pela Georgia em face da Rússia.[1]
A decisão matéria de
admissibilidade foi proferida pelo Corte Europeia de Direitos Humanos em 13 de
dezembro de 2011.[2]
Acerca do caso, o Conselho
da Europase manifestou da seguinte forma:
5. In terms of security, the situation remains tense,
particularly for those close to the ABL, but not at the level which led to the
2008 war. A large Russian military presence, both in Abkhazia, Georgia and
South Ossetia, Georgia, is seen in contradictory ways. On the one side, it is
seen by Georgia and most of the international community as an occupation of
part of the country by the troops of a neighbouring country.On the other, it is
seen by the Russian Federation and the de facto authorities as a guarantee
against renewal of the conflict. What is needed to restore security and
long-term trust is not armies facing each other along the ABL, but a strong,
non-partisan international peacekeeping and monitoring presence on both sides
of the line.[3]
Os territórios da
Ossétia do Sul e da Abkhazia foram palco de um curto conflito militar
envolvendo a Rússia e a Geórgia em agosto de 2008. Os dois países chegaram a um
acordo com auxílio de mediação do governo francês. No entanto, o acordo que
previa a retirada das forças russas não foi cumprido, a região permanece sob
controle russo e este país reconheceu a independência das duas regiões, além de
manter apoio a seus governos de fato e controlar o acesso aos territórios.[4]
