Qual a natureza jurídica do direito internacional público? Notas sobre uma falsa questão e as preocupações dos internacionalistas.

Qual seria a natureza jurídica do Direito Internacional Público?! De lei ou modalidade de ato administrativo?

Essa parece uma falsa questão. Pode-se perguntar sobre a natureza jurídica dos fatos jurídicos dentro de certo sistema normativo, mas não parece adequado indagar acerca da natureza jurídica do sistema em si. Seria como indagar com qual parte mais se parece o todo.

Por outro lado, seria possível indagar sobre a natureza jurídica de um tratado internacional, ou de uma resolução de uma organização internacional. No entanto, os jusinternacionalistas pouco têm atentado para o problema dos atos jurídicos, concentrando sua atenção no processo de formação das normas internacionais, isto é, na teoria das fontes (WEIL, 1992, p. 133).
Tanto é assim que nos manuais de direito internacional, tratados e atos unilaterais dos Estados são vistos pelo ponto de vista das fontes do direito e não como atos jurídicos. Ilustrativo disso é que os tratados são contrapostos aos costumes internacionais e não aos atos unilaterais dos Estados (WEIL, 1992, p. 133).
O pouco interesse da doutrina internacional na teoria dos atos jurídicos explica em parte a dificuldade do direito internacional em trabalhar com o tema das nulidades (WEIL, 1992, p. 315).
Entretanto, há fortes razões para que se desenvolva no âmbito do direito internacional a teoria dos atos jurídicos. A ordem internacional tem evoluído e tende a comportar um exame mais sofisticado do caráter dos atos nela praticados, que deverá somar-se à tradicional análise das fontes e, quiçá,  vir a substitui-la (WEIL, 1992, p. 134).
A análise de Prosper Weil, em seu curso geral na Haia há 20 anos, continua pertinente. Atualmente é maior a preocupação da doutrina internacional com a emergência de novos ramos derivados do direito internacional, isto é, com o chamado processo de fragmentação ou especificação do direito internacional, do que com a elaboração de uma teoria dos atos jurídicos na esfera internacional.

Law: Lecturer in International Criminal Law

The School of Law invites applications for a lecturer in international criminal law. Applicants must be capable of teaching general public international law and international criminal law at LLB and LLM levels. An interest in international law on armed conflict and the use of force, and United Nations law, would be advantageous. The successful applicant will ideally have a good record of research publications (or prospective publications) and will be expected to contribute to the School's 2013 REF submission.
It is essential that the successful candidate's research furthers the high international reputation of the School, and that he or she demonstrates strong commitment to teaching and administration. Outstanding achievement or demonstrable potential for excellence, in research will be an essential criterion of appointment.
The position is available from 1st August 2012. Appointment will be on an open-ended basis.
